Michael L. Lofton (Address deleted for privacy) June 19, 2011 The President, Mr. Barack Obama United States of America The White House 1600 Pennsylvania Avenue Washington, D.C. 20500 The Honorable Dianne Feinstein, U.S. Senator United States Senate 331 Hart Senate Office Building Washington, D.C. 20510 The Honorable Karen Bass, U.S. Congresswoman, U.S. House of Representatives, 408 Cannon HOB, Washington DC, 21515 RE: Checks and balances between the branches of government to protect and serve law abiding U.S. citizens egregiously violated by government when the court system fails to uphold the U.S. Constitution, the California Constitution and/or rule of law. Dear President Barack Obama, Congresswoman Karen Bass, Senator Diane Feinstein: As a better than thirty year taxpaying resident of the City of Los Angeles, specifically the 33rd Congressional district, 2nd Los Angeles County District, and 10th Los Angeles City Council District, I petition you for redress where the Superior Court of the County of Los Angeles has failed to uphold the rule of law, the U.S. and California Constitutions. Since January 19, 2011, I have been without water because LADWP water utility workers removed LADWP's water meter, and installed a tamper-proof plug on the utility source, leaving me without a source of water to my residence. I’m also a 30 year employee of the LADWP to which a substantial sum of my earned retirement benefits are being held hostage by the LADWP, while the LADWP threatens to discontinue electric service to my residence. This is of court record in Los Angeles Superior Court Case 10K18049, the Demurrer to Case 10K18049, and the proposed Judgment order before Judge Steven Kleifield. http://www.lasuperiorcourt.org/aboutcourt/admin.htm JUDICIAL ADMINISTRATION, Judge: An official of the judicial branch of government with authority to decide lawsuits and preside over trials brought before the court. The term “judge” may also refer to all judicial officers, including Supreme Court justices. An applicant for appointment as a judge must have been admitted to practice law in California for at least 10 years. NON-JUDICIAL ADMINISTRATION, The Executive Officer/Clerk, under the direction of the Presiding Judge, supervises all administrative activities and personnel, coordinates all staff activities and has charge of planning and improving management methods. A signed or unsigned clerk’s default judgment and/or any other form of clerk’s judgment are inappropriate, voidable, and unenforceable. Deputy Clerk Delores Odom-Stocks should be fired. Deputy Clerk Delores Odom- Stocks is not qualified to render a court decision. This should not be allowed on my “dime”, and at the expense of the rights of Michael L. Lofton, et al. It is definitely inappropriate for any judge to enter a default judgment against Michael L. Lofton, the only party to appear on January 27, 2011. I paid the necessary filing and court fees in the amount of $370.00 to the Stanley Mosk Los Angeles Superior Court. Article 6, Section 19, of the California Constitution mandates Judge Steven Kleifield, the judge of court of record, render the appropriate court decision. Since there are no issues in dispute in LA Superior Court Case 10K18049, and LA Superior Court Case 895188, then execution and enforcement of the law are warranted for the plaintiffs in LA Superior Court 10K18049, and for the plaintiffs in Superior Court Case 895188. The Job of the Congressman, “There are cases where an individual has been wrongfully treated by his government and about the only way, unless the individual resorts to court, and even in some cases the courts are not able to give proper relief, the only area or avenue open to the individual is through his representative. When you find a bona fide error has been made, I suggest that you make a maximum effort to remedy it. This I feel is a vital and important function of those of us in the House of Representatives”. Authors: Donald G. Tacheron and Morris Udall, from the book entitled, “The Job of the Congressman”, pages 65 and 66. (The above excerpt from “The Job of the Congressman” holds true for any elected office holder, and/or U.S. Citizen.) I’m petitioning you, as a law abiding taxpaying citizen so that you and other elected officials can exercise your authority to: Hold Judge Steven Kleifield accountable to Article 6, Section 19, of the California Constitution to resolve LA Superior Court Cases 10K18049, 895188, and the proposed judgment order in his possession.....the buck stops with Judge Lee Smalley Edmond Uphold the 14th Amendment, USC, “Equal Justice and Protection Under the Law”, to resolve LA Superior Court Cases 10K18049, 895188, and the proposed judgment order. Sincerely Michael L. Lofton 2 enclosures, (1) Unenforceable clerk’s default judgment as signed by Deputy Clerk Delores Odom-Stocks (2) Court fee payment receipt. Cc: Attorney Brian N. Winn, Winn Law Group, 110 E. Wilshire Avenue, Suite 212, Fullerton, CA 92832, no front letter. ***************************************************** "Insisting on honesty as the only policy, the Supreme Court ruled Wednesday that public employees can be punished for lying, even when they merely deny an accusation that later turns out to be true”. “ ….Chief Justice William H. Rehnquist. 'An employee who is asked about possible wrongdoing has only two responses: Tell the truth or say nothing”. (LA Times, January 22, 1998) ........"Tell the Truth or Say Nothing" also applies to everyone, which includes the President of the U.S., any Supreme Court Justice, County Court Presiding Judge, County Court Assistant Presiding Judge, Judge, court "issuing worthless and unenforcable clerk judgment "clerk-ment" clerks, Deputy City Attorney, elected official, Police Chief, police officer, lawyer, journalist(s) or newspaper publisher, social worker, probation officer, electrician, etc. PS: To date, President Obama, Congresspersons Allen West and Karen Bass, and 2nd District Supervisor Mark Ridley Thomas have not responded. Congresswoman Maxine Waters is the only elected official who shows interest in the concerns of inner-city residents. Senator Diane Feinstein local and county government elected officials are dysfunctional. There is no question that elected black leaders are dysfunctional and don't intend to uphold the "rule of law". |
